LeakStop Terms

What LeakStop Promises

These terms (the "Terms") apply to your purchase of LeakStop from Flat Roof Systems Group LLC("FRSG"). By purchasing LeakStop, you agree to these Terms. If you purchase on behalf of a business or property owner, you confirm that you are authorized to do so.

LeakStop is a prepaid, fixed-price service to stop or safely contain active water intrusion through the roof at the building you identify. Your purchase covers the number of leaks selected when you pay and arrival within the applicable Arrival Window, subject to the access and safety provisions below. The LeakStop Guarantee applies to the condition of the reported roof leaks when the crew leaves.

If the roof needs more than a LeakStop, we document what we found and price the repair before any additional work. You never pay for work you didn't approve. See Roof Repairs.

What Counts as a Leak

A leak is one place where water is coming into the building. Drips within a few feet of each other count as one leak; drips in different rooms count as separate leaks. Your purchase covers the number of leaks selected at checkout. Additional leaks are priced separately and require your approval before additional work is performed.

Emergency Arrival and the Night Fee

The "Arrival Window" is the period within which FRSG agrees to arrive at your building. Emergency Arrival is a two-hour window beginning two hours after payment completes. Standard Arrival is within 24 hours after payment completes; FRSG calls to arrange the time. Arrival times are stated in Pacific time. The confirmation call does not restart or extend the Arrival Window.

Emergency Arrival carries an additional charge above the Standard Arrival price (the "Emergency uplift"). A $195 "Night Fee" also applies to Emergency Arrival purchases begun at or after 8 pm and before 6 am Pacific time, determined at the moment you begin paying. The total displayed before the pay button includes any applicable Night Fee. Standard Arrival does not carry a Night Fee. Weekends and holidays carry no additional charge.

The Guarantee

If any reported roof leak covered by your purchase is still taking water when the crew leaves, FRSG will refund your entire purchase, including the Emergency uplift and any Night Fee. The refund applies to the whole purchase, not only to the affected leak. This guarantee covers water coming through the roof and is subject to the access and non-roof water-source provisions below.

FRSG issues refunds under these Terms within one business day of determining that a refund is due. For a refund under the LeakStop Guarantee, that determination is made at the visit and the refund is issued within one business day of the visit. Your bank may take 5 to 10 business days to show the refund in your account.

Missed Arrival Windows

If FRSG misses your Emergency Arrival window, FRSG will refund the Emergency uplift and any Night Fee. The visit proceeds at the Standard Arrival price. If FRSG misses your Standard Arrival window, FRSG will refund your purchase in full unless you ask FRSG to proceed with the visit despite the delay.

No Access or Not a Roof Leak

You are responsible for arranging access to the building, roof, and reported leaks. If access is unavailable when the crew arrives, the crew will call the contact supplied with your purchase and wait 20 minutes. If access remains unavailable, the crew will leave, the visit is used, and no refund is due for lack of access. A return visit requires a new LeakStop purchase. Unsafe roof or weather conditions are governed by the separate provision below.

If the crew determines that the water comes from plumbing, HVAC, a wall, or another source other than the roof, the visit is the service provided. The crew will tell you where the water is coming from. The LeakStop Guarantee does not apply to that water source, and no refund is due on that basis. A subsequent LeakStop visit requires a new purchase.

Cancellation

After payment, FRSG will call you to confirm the service. Before asking for your authorization to proceed, FRSG will explain that authorizing the service ends your eligibility for a change-of-mind refund. You may cancel for a full refund at any time before giving that authorization, including during the confirmation call, by telling FRSG on the call or emailing contact@frsgusa.com.

Once you authorize FRSG to proceed on the confirmation call, FRSG commits the crew to your service. A subsequent cancellation because you no longer want the service is not refundable, whether or not the crew has left for your building or begun work at the property. FRSG records the time of your authorization. An unanswered call or voicemail does not constitute authorization.

This cancellation provision does not limit refunds available under the LeakStop Guarantee, the missed Arrival Window or unsafe-condition provisions, or applicable law. Nothing in these Terms excludes or restricts any cancellation, refund, or other right that cannot lawfully be excluded or restricted.

Unsafe Roof or Weather

If the crew determines that roof or weather conditions make the work unsafe, you may choose either a return visit as soon as conditions are safe at no additional charge or a full refund. If the safety delay extends beyond your Emergency Arrival window, FRSG will refund the Emergency uplift and any Night Fee whether you choose a return visit or cancellation.

Work Begins Immediately

At checkout, you are asked to agree that FRSG may begin work immediately, before Oregon's next-business-day cancellation period ends. FRSG accepts that request. For contracts subject to ORS 701.310, subsection (2)(a) provides an exception to that cancellation period when both parties agree that work is to begin before the period expires.

Your immediate-work agreement is separate from your authorization to proceed on the confirmation call. It does not end the full-refund cancellation option described above before that authorization or waive any other applicable statutory right.

Washington Notice to Customer

For service at a building in Washington, the crew carries a paper Notice to Customer and provides it for your signature before work begins. You receive a copy, and FRSG retains the signed notice. This is the separate contractor disclosure described in RCW 18.27.114. Acceptance of these Terms does not replace delivery and acknowledgment of that notice.
